The Consejo Consultivo de Andalucía (Regional Advisory Board) has back Motril Town Halls proposal to compensate a woman after a fall on a pavement.
The woman stepped on a manhole cover, which was not secure, injuring one of her legs in the fall after it entered up to her knee.
The woman attributed her fall to the faulty cover over an inspection point for public lighting. Town Hall maintenance workers confirmed that the supporting lip on which the cover sits was deteriorated. The Policía Local also took photographs which confirmed the defective state of the aperture cover.
It has since been replaced.
For this reason the Advisory Board rejected any fault on the part of the victim (negligence/undue lack of attention) as the cover had the appearance of being in a good state and secure.
Consequently, the woman will put in for 22,857 euros for damages whilst the Town Hall put it as 1,284 euros. The Advisory Board considers the Town Hall figure to be the correct one and that payment should go ahead.
